These Terms & Conditions (“Terms”) govern your access to and use of the BizCardPro.AI application, websites, and related services (together, the “Service”). The Service is operated by the provider of BizCardPro.AI, based in Hong Kong SAR (“we”, “us”, or “our”).
By creating an account, ticking “I agree”, or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Eligibility
The Service is open to the public. You must be at least the age of majority in your jurisdiction (or at least 18) and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. The Service
BizCardPro.AI lets you capture, scan, extract, organize, store, and export information from business cards and similar documents, and provides related contact-management features. We may add, change, or remove features at any time.
3. Your Account
You are responsible for the accuracy of your registration information, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use. You may sign in using third-party providers (for example, Google); your use of those providers is also subject to their terms.
4. Your Content and Your Rights
“Your Content” means the images, business cards, contact details, notes, and other information you upload to or create in the Service.
- You keep ownership of Your Content. These Terms do not transfer ownership of Your Content to us.
- You are responsible for Your Content. You represent and warrant that you have the necessary rights, permissions, and — where required by law — the consent of the individuals concerned to upload, scan, store, and process the personal information contained in the business cards and contacts you submit, and that doing so does not violate any law or third-party right.
5. How We Use Your Information
To provide the Service, you grant us — and our affiliated companies, being entities under common ownership or control with us — a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, adapt, and analyse Your Content and related information for the purpose of operating, maintaining, securing, supporting, and improving the Service and providing its features to you. Sharing of personal information within our corporate group is described in our Privacy Policy.
We are committed to handling your information responsibly. To keep BizCardPro.AI reliable and to make it better over time, we may also:
- analyse usage activity and content — typically in aggregated or de-identified form — to understand how the Service is used, to measure and improve accuracy, quality, and performance, and to develop and enhance features and the overall user experience;
- use information to help train, evaluate, and improve the models and technologies that power the Service’s recognition and organization features; and
- generate aggregated statistics and insights that do not identify you or any individual.
We do not sell Your Content. Our collection and use of personal information are described in more detail in our Privacy Policy, which forms part of these Terms. Where the law requires your consent for a particular use, we will obtain it as required.
6. Acceptable Use
You agree not to:
- use the Service unlawfully, or to upload data you have no right to use;
- upload malicious code, or attempt to disrupt, reverse-engineer, scrape, or gain unauthorized access to the Service or its systems;
- use the Service to send spam or to harvest personal data in violation of applicable law;
- infringe the intellectual property, privacy, or other rights of others; or
- resell or commercially exploit the Service except as expressly permitted.
We may suspend or terminate access for conduct that we reasonably believe violates these Terms or harms the Service, other users, or third parties.
7. Intellectual Property
The Service, including its software, design, branding, and content (excluding Your Content), is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Service in accordance with these Terms. All rights not expressly granted are reserved.
8. Third-Party Services
The Service relies on third-party providers (for example, cloud hosting, authentication, payment processing, and AI processing). Your use of the Service may be subject to those providers’ terms, and we are not responsible for their acts or omissions.
9. Subscriptions and Payments
Paid plans are billed monthly through our payment processor, Stripe; we do not see or store your full card number. Prices, quotas, and billing cycles are presented at purchase and on our pricing page. Upgrades take effect immediately with prorated billing; downgrades take effect at the end of the current billing period. You can cancel at any time, effective at the end of the current billing period. Except where required by law, fees already paid are non-refundable.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, non-infringement, and accuracy. Automated recognition and extraction may contain errors; you are responsible for verifying extracted information before relying on it. We do not warrant that the Service will be uninterrupted, secure, or error-free.
11. Limitation of Liability
To the maximum extent permitted by law, we (and our directors, employees, and suppliers) will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, data, goodwill, or business, arising out of or relating to your use of the Service. Our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US$50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your breach of these Terms or of any law or third-party right.
13. Termination
You may stop using the Service and request deletion of your account at any time. We may suspend or terminate your access if you breach these Terms or as reasonably necessary to protect the Service or others.
How to request account termination. To close your account and have your associated data deleted, send a request to termination-request@bizcardpro.ai. So that we can locate your account and confirm that the request genuinely comes from you, please include:
- the email address registered to your account;
- your full name as it appears on the account;
- the sign-in method you use (for example, email & password, or Google);
- a brief statement confirming that you are the account owner and that you wish to terminate the account and delete its associated data;
- if you have a paid plan, any active subscription or billing reference so we can address renewals; and
- (optional) the reason for your request, which helps us improve the Service.
For faster verification, please send the request from the email address registered to your account. We may request additional information reasonably necessary to verify your identity before acting on a request, and we aim to process verified requests within 30 days. Some information may be retained after termination where required for legal, security, accounting, or other legitimate business purposes, as described in our Privacy Policy.
Provisions that by their nature should survive termination (including Sections 4–5, 7, and 10–15) will survive.
14. Changes to the Service and Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, in-app or by email). Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts of Hong Kong SAR, unless mandatory local consumer law provides otherwise.
16. General
These Terms (together with the Privacy Policy) are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
